Remove "Boss" Ballman from the 84th District Office of Texas

On May 12, 2005 my teenage daughter was hit by an intoxicated driver in Borger, Texas. This driver didn’t stop when he hit Gina. He drove away and she followed while dialing 911 on her cell phone. Several blocks later the other driver’s car finally stopped and the police arrived. My daughter was shaken when she called and told me District Attorney Clay Ballman had hit and run from her. - Betty Holland

Betty Holland"s Story

This is a frustrating story about how myself and 800 petitioners in my hometown have tried to have the district attorney removed from office under Chapter 87 of the Texas Government Code. We refer to him as "Boss" because it was the alias on his arrest record. We see him as a disgrace as the attorney for the people he is representing in Hutchinson County and Hansford County...the 84th district in Texas. The DA was convicted on the DWI charge in an adjoining county courtroom and through legal maneuverings was not charged with the hit and run. Strange how Gina, my daughter was not called as a witness at his trial. "Boss" didn’t follow the implied consent law he has sworn to uphold. He refused field sobriety tests and a specimen of his breath. He didn’t spend the night in jail because Judge Smith released him. Allegedly, he and the Judge were previously socializing together the night of the arrest. Also, it was alleged the district attorney was pulled over for DWI a year earlier (2004) and was let go. It’s no surprise that the video is missing. A year later (7-2006) after his DWI conviction, the Boss was in the news again. A Sheriff’s report said he was intoxicated with another individual in the courthouse parking lot and an employee from the jail drove the two men home. Channel 10 CBS news in Amarillo, Texas reported the district attorney’s DWI conviction was not listed in crime records in the Texas Department of Public Safety data base. If the district attorney doesn’t have to follow the law when it comes to his freedom, why should anyone else? - Betty Holland
